Was sagt unser Rechtsexperte Leto dazu?
Dass Gerichte an Recht und Gesetz gebunden sind, ist nichts neues.
Steht also klar und deutlich:
Kein Gericht ist befugt, ein Dekret des Präsidenten diesbezüglich zu überprüfen.
Das steht da nicht. Nun müsste man die ganze Bundesgerichtsverfassung, in den USA auch alle möglichen Präzedenzfälle, und die Oberste Rechtsprechung dazu abarbeiten. Das ist dann weniger mein Spezialgebiet.
Es steht sogar Wort-Wörtlich drin:

Soll ich übersetzen?
Zwischen den Kommata steht eine Einschränkung und die müsste man abklopfen.

Wenn Du das meinst, dann gibt es dieses " expressly authorized by law" NICHT.
Das kann ich nicht beurteilen, das wird ein zuständiges Gericht tun müssen.
Grundsätzlich sollte jegliches Verwaltungshandeln auch einer gerichtlichen Überprüfung standhalten können müssen.
Ich habe das Urteil nicht geschrieben. Es steht so wie es steht.
Das Urteil bezieht sich auf ein District Court und sagt nichts über Gerichtsverfassung der Bundesgerichtsbarkeit. Ein Gericht muss immer auch seine Zuständigkeit prüfen und dieses Gericht kommt da zu einem anderen Ergebnis, als Du, und damit ist der Weg durch die Instanzen offen, bis zum Obersten Gericht, welche dann über die Zuständigkeiten der Bundesgerichte entscheidet.

Anzumerken, die Urteile des 9. Berufungsgerichtes wurden zu 80% durch das Verfassungsgericht verworfen.
Bei Nicht-Zuständigkeit wären es 100.

Flynn worked for multiple Russian firms
President Trump’s former national security adviser, Michael Flynn, received $56,250 in payments from Russian firms during the presidential race for work done for two Russian firms and Kremlin-backed news outlet RT, according to new documents obtained by a House Oversight panel.

White House aide Sebastian Gorka on Thursday denied a report in The Forward alleging that he belongs to a Hungarian knightly order founded by a Nazi-allied leader who oversaw the deportation of hundreds of thousands of Jews during the Holocaust.
In a statement to Tablet, Gorka said he never joined the Vitezi Rend, or Order of Vitéz, and only wore a medal associated with the order to commemorate his father.
“I have never been a member of the Vitez Rend,” Gorka told Tablet. “I have never taken an oath of loyalty to the Vitez Rend. Since childhood, I have occasionally worn my father’s medal and used the ‘v.’ initial to honor his struggle against totalitarianism.”
The publication also spoke to two current members of the group who say Gorka swore a lifelong loyalty oath to become a member. Those members said Gorka belonged to the “Historical Vitezi Rand,” one of two splinter organizations that claimed to carry on the group’s legacy after its original iteration was banned in 1947.....
Gorka previously drew scrutiny for wearing the Order of Vitéz medal to a Trump inaugural ball and for his ties to members of Hungary’s anti-Semitic Jobbik party. He has maintained that the medal was awarded to his father in 1979 for his work as a spy for the British in Soviet-era Hungary.
Several Jewish groups, which have previously criticized Gorka’s affiliations with the Order of Vitéz and with Jobbik, spoke out about the Forward’s report.
Steven Goldstein, executive director of the Anne Frank Center for Mutual Respect, called for Gorka’s resignation and condemned the “grotesque anti-Semitism that has infected the Trump White House.”

Anti-Defamation League CEO Jonathan Greenblatt said he was “deeply disturbed” by the allegations about Gorka’s formal membership in the Order of Vitéz.
“If true, he needs to renounce his membership immediately and disavow their exclusionary message of hate,” Greenblatt said in a statement. “At a time of rising anti-Semitism around the world, it is essential for Mr. Gorka to make clear that he rejects the policies of far-right and nativist organizations such as Vitézi Rend and Jobbik, which have a long history of stoking anti-Semitism and intolerance in Hungary.”

Report: Group Linked To Nazi Ally Says Gorka Took Loyalty Oath To Be Member
...Two members of Vitézi Rend, or the Order of Vitéz, told the Forward that Gorka took a lifelong loyalty oath to become a full member of the organization.
“Of course he was sworn in,” Kornel Pintér, one of the group’s leaders in West Hungary, told the Forward of Gorka. “I met with him in [the city of] Sopron. His father introduced him.”
“In today’s world it is rare to meet anyone as well-bred as Sebastian or his father, Pali,” Pintér added.
The former Breitbart News-editor-turned-top-counterterrorism-adviser has acknowledged wearing a medal associated with the Order of Vitéz to one of President Donald Trump's inaugural balls. But he has not acknowledged any personal association with the group, saying the medal was awarded to his father in 1979 in recognition of his anti-communist efforts. Gorka's father was a spy for the British in Soviet-era Hungary.
Pintér told the Forward that joining the group involves a formal initiation rite in which new members swear loyalty to Hungary and the Order, and promise to follow the group’s leaders “for the rest of my life.”

Flynn, who parted ways with the Trump White House in February after it became clear he lied about communicating with the Russian ambassador about sanctions before inauguration day, had previously denied he had taken money from Russia for the speech.
“I didn’t take any money from Russia, if that’s what you’re asking me,” Flynn told Yahoo in July, when he was working as an adviser for the Trump campaign.

Wenn dem so ist, so war es den beiden Vorgänger-Administrationen aber auch egal, es war den jeweiligen Senaten egal und es war den jeweiligen Häusern egal. Damit sind wir dann aber bei einer ordentlich breit angelegten Verschwörung angelangt.
