Trump will shrink Bears Ears during Utah visit Monday, when five tribes promise to sue him
President Donald Trump will fly into Utah on Monday to announce that he’ll shrink the Bears Ears and Grand Staircase-Escalante national monuments, sources familiar with the trip confirmed to The Salt Lake Tribune.
Trump will travel to Salt Lake City, where he’ll explain why he’s changing the boundaries of the two monuments, the sources said on condition of anonymity because they were not authorized to speak publicly about the trip.
The president is not expected to visit either monument or stay in Utah overnight. ....

Environmentalists and tribes have said they will seek legal action to stop any changes, which they don’t believe the president can do under the 1906 Antiquities Act.
“The tribes view this as an affront to themselves and their own self-determination,” said Natalie Landreth, senior staff attorney for the Native American Rights Fund. “All of us, all five tribes, will be suing jointly the day he makes an announcement.”
Five tribes — the Hopi, Navajo Nation, Ute Mountain Ute Tribe, Pueblo of Zuni and the Ute Indian Tribe — make up the Bears Ears Inter-Tribal Coalition that advocated for the monument. Landreth said they have not determined which federal court the group would file the lawsuit in but that it would be about violating the Constitution’s separation of powers.

Uzbekistan incident raises suspicions of Russian involvement in Cuba attacks
A newly revealed incident reported by a USAID officer who is based at the American embassy in Uzbekistan is raising suspicions Russia may have been involved and could have had a hand in bizarre attacks targeting U.S. diplomats in Cuba, according to American sources.

In September, the officer and his wife reported, according to one source familiar with the incident, what may have been at least one acoustic attack similar to those experienced by the diplomats in Havana.

Navajo Nation delegate rips Trump: Code Talkers aren't 'pawns to advance a personal grudge'
A Navajo Nation Council delegate ripped President Trump after the president called Sen. Elizabeth Warren (D-Mass.) "Pocahontas" during an event honoring Navajo Code Talkers.

In a statement, Navajo Nation Council Delegate Amber Kanazbah Crotty said Trump's "careless" comment is the "latest example of systemic, deep-seated ignorance of Native Americans and our intrinsic right to exist and practice our ways of life."
"The intentional disregard of the historical trauma of Pocahontas as a sexual assault survivor directly resulting from colonization is disturbing," she added.

Crotty said the Navajo people aren't strangers to prejudice, discrimination and marginalization "perpetuated by western culture."
"Our woman and children are targets of violence. We must speak out against such ignorance in every instance, in hopes for a better future for our children and our land," Crotty said.

Crotty said Trump's remark is "problematic" and it diminishes the experience of Pocahontas.

But two overall points are clear. 1) The transition needed to make sure Obama did not create an escalation of tensions that made Trump’s rapprochement impossible. 2) More based on point two than on point three, it’s clear McFarland knew that Russia had in fact intervened in the election. Otherwise why anticipate a report that “catches Russians red handed”?

If the fullness of what happened during 2016 became known (even if it was only Russian actions on behalf of Trump and not Trump advisors conspiring with Russia) that would make the grand bargain impossible, as McFarland clearly understood. It had to become a fait accompli before the full story emerged. Indeed, if the Trump Team could get in place before most of the information was revealed it might never become known at all since they would take over the key agencies doing the investigating. The urgency of reaching out to Kislyak was to make sure a rapprochement was still possible by late January. Yet it was the fact that Flynn got caught doing so that became the central reason the Trump Team’s plans for January and February were eventually dashed. ...

...What matters for our purposes is that only days after the inauguration the two trains were colliding – the investigators and the press were catching up with the Trump team’s efforts and about to upend them. ...

Despite the claim that Flynn had gone rogue and that Vice President Pence was lied to, details that emerged in the Flynn plea documents make clear that Flynn’s discussions with Kislyak were widely discussed among President Trump’s top advisors. Pence almost certainly knew about them, though we as yet have no direct proof of this. Events were moving rapidly. A string of denials about Flynn’s conversations with Kislyak were hit with a rush of leaks that refuted each in turn. By February 13th Flynn was out. The next day President Trump asked Comey to drop the investigation into his activities. Comey politely refused. Events were moving quickly and badly.

Various reports, including Isikoff’s, tells us that the staff planning for a rapprochement which was kicked off in the administration’s first days continued. Indeed, in the months since we’ve seen it pop up here and there. There have been repeated hints of discussions to return the diplomatic compounds seized by the Obama administration in late December. In his May trip to Europe Trump had to be coaxed and prodded to commit to the defense of NATO allies. We saw it in Trump’s bizarre and semi-secret Oval Office meeting with Kislyak and Lavrov just after firing Comey. Still, it seems clear that by mid-February, with Flynn fired and the Russia scandal dominating the headlines, any hope of an immediate and thorough-going reset in relations with Russia were abandoned as unrealistic.
While the desire is clearly still there, it has been the drama of the unfolding investigation, rather than a grand partnership with Russia that has dominated the news and the administration ever since.

Jared Kushner’s ‘failure to disclose’ list grows to include illegal Israeli settlement foundation
Kushner has already revised his security clearance application three separate times.

President Donald Trump’s son-in-law and senior advisor Jared Kushner failed to disclose to the federal government his position as the co-director of a foundation that funded an Israeli settlement considered to be illegal under international law, according to a Newsweek report published Sunday.

This latest failure to disclose is one in a growing list that includes:
- Kushner’s failure to disclose to the Senate judiciary committee emails sent to Trump’s campaign team about WikiLeaks and a “backdoor overture” from Russia during the 2016 presidential election campaign, according to The Guardian.
- And Kushner’s failure to disclose business ties to a Russian oligarch who helped Russian government institutions invest in the social media platform companies Facebook and Twitter, according to a November report in the HuffPost.

The latest disclosure revelation was unearthed by researchers at American Bridge, a progressive research and communications organization, and shared with Newsweek, which independently confirmed Kushner’s omission on various financial disclosures.
“The researchers suggested Kushner’s failure may have been more than an inadvertent mistake, but instead an attempt to avoid ‘potential conflicts with his job negotiating Middle East peace,’” according to Newsweek.

...The information comes on the heels of reports on Friday that indicated that Kushner may have attempted to influence a United Nations Security Council vote against an anti-settlement resolution that condemned the structure of West Bank settlements. The resolution passed shortly before Trump took office. ...

Experts and officials told Newsweek that Kushner’s failure to disclose his “role at the foundation — at a time when he was being tasked with serving as the president’s Middle East peace envoy — follows a pattern of egregious omissions that would bar any other official from continuing to serve in the West Wing.”

Note a few things we now know from the follow-on reporting on the Flynn plea agreement.

The senior transition official who Flynn called into to confer on his conversations and negotiations with Russian Ambassador Kislyak was KT McFarland. Flynn conferred with McFarland and McFarland conferred with a group of other senior officials which, as I noted last night on the basis of the contemporaneous pool reports, appears to have been Stephen Miller, Steve Bannon, Kellyanne Conway and Reince Priebus.

McFarland had been tapped to serve as the Deputy National Security Advisor, a position she held until May. Her main qualification for the job was a long stint as a “Fox News National Security Analyst” ...

...In other words, McFarland is a clown, a product of the New York GOP/Fox News/Roger Ailes ridicu-verse. The larger group she and Flynn were conferring with about carrying on a covert negotiation with the Russian Ambassador were basically people of the same caliber with the exception of Priebus, who is a fairly seasoned political operative but not someone with foreign policy experience. ...

We already know that Kushner was one of the most vocal advocates of firing Comey. McFarland’s role in that critical weekend is noteworthy since we now know she was tightly connected to one of the central questions Comey was investigating – not only the broader Russia scandal but the specifics of Mike Flynn’s conversations with Kislyak which Trump had already asked Comey to leave alone.

Again, at every stage, when the key decisions get made, Trump is with the worst of his advisors, the least qualified, most aggressive and enabling, the most dishonest and corrupt. It’s a recipe for bad outcomes since Trump is in his element.

Desperate times call for desperate measures.
President Trump’s former campaign manager, Paul Manafort, has been indicted. Michael Flynn, Trump’s former national security adviser and one of his closest confidants, has flipped and is cooperating with special prosecutor Robert Mueller. Trump himself sent out a tweet over the weekend that, according to legal experts, makes the case against him for obstruction of justice.

This morning, in a seemingly coordinated effort, Trump embraced the idea that he did not obstruct justice because the “President cannot obstruct justice.”
The argument is an attempt to justify Trump’s actions in February, when he pressured former FBI Director James Comey to drop the investigation of Flynn and then fired Comey when he refused to comply.

Mueller has arrested 4 ex-Trump advisers in 6 months, signaling peril ahead for White House
After six months of work, special counsel Robert Mueller III has indicted two top advisers to President Donald Trump and accepted guilty pleas from two others in exchange for their cooperation with his probe into Russian meddling in the 2016 election - a sign of mounting legal peril for the White House.

With the guilty plea Friday by former national security adviser Michael Flynn - one of Trump's closest and most valued aides - the investigation has swept up an array of figures with intimate knowledge of the campaign, the transition and the White House.
